1The agreement
These terms govern your use of the Founder Bottleneck Scorecard at this address (the “scorecard”), operated by Consult with Krishna (“we”, “us”). Submitting the form means you accept them. If you do not, do not submit it.
Our Privacy Policy forms part of these terms and explains what happens to what you send.
2What the scorecard is, and is not
The scorecard is a self-assessment. You rate ten aspects of how your business runs, and it returns a score out of 100, a band, and a written summary generated by fixed rules from your own answers.
It is not professional advice. Nothing on the results page or in the email is business, legal, financial, tax, accounting, medical or employment advice, and no consultant-client relationship is created by using it. Decisions you take about your business remain yours.
A consulting engagement with Krishna is a separate matter, governed by a separate written agreement. Nothing here commits either of us to one.
3Who may use it
You must be 18 or over and using the scorecard for a business you own, run or work in. If you submit on behalf of an organisation, you confirm you are authorised to do so.
4Acceptable use
You agree not to:
- Submit an email address that is not yours or that you are not authorised to use.
- Submit automatically, at volume, or in any way designed to defeat the rate limiting or spam screening.
- Probe, scan, overload or interfere with the service, or try to reach any part of it you were not given access to.
- Scrape, copy or republish the questions, bands or summary text as your own product.
- Use the scorecard to send unlawful, abusive or misleading content to anyone.
We may rate-limit, block or refuse any submission, without notice, to protect the service or anyone else using it.
5Your answers
You keep ownership of what you submit. You grant us permission to process it to produce your score, to email it to you, and to contact you about your result.
The output is only as good as the input. Rushed or inaccurate answers produce a score that describes nothing, and we are not responsible for that mismatch.
Do not submit confidential information, personal data about other people, or anything you are not free to share. The form asks for a score out of ten, not your books.
6The emails you receive
Submitting the form triggers one email to you containing your breakdown. This is a transactional message you asked for, not marketing.
Krishna may reply personally about your result. If you would rather he did not, say so in a reply and that is the end of it. Delivery depends on your mail provider; a score that lands in spam is not something we can control, and your score is shown on screen either way.
7Intellectual property
The scorecard - its questions, scoring model, bands, written summaries, design and code - belongs to Consult with Krishna and is protected by copyright. You may use your own results however you like, including inside your business. You may not copy, adapt, resell or build a competing assessment from the questions or the scoring logic without written permission.
8Third-party services and links
The scorecard relies on third-party providers for email delivery, hosting and abuse prevention, and links out to consultwithkrishna.com and elsewhere. We do not control those services or sites and are not responsible for their content, availability or terms.
9Availability
The scorecard is provided as-is and as-available. We do not promise it will be uninterrupted, error-free, or available at any particular moment, and we may change, suspend or withdraw it at any time. To the fullest extent the law allows, we exclude all implied warranties, including merchantability, fitness for a particular purpose, and non-infringement.
10Limitation of liability
To the fullest extent permitted by law, we are not liable for any indirect or consequential loss, or for loss of profit, revenue, business, goodwill, data or anticipated savings, arising from your use of the scorecard or from any decision you take on the strength of a score.
Our total liability arising out of or in connection with the scorecard is limited to INR 5,000, or the amount you paid us to use it, whichever is greater. The scorecard is free, so in practice this is a cap on a service you paid nothing for.
Nothing here limits liability for death or personal injury caused by negligence, for fraud or fraudulent misrepresentation, or for anything else that cannot lawfully be limited. Where you use the scorecard as a consumer, your statutory rights are unaffected.
11Indemnity
You agree to indemnify us against claims, losses and reasonable costs arising from your breach of these terms, your misuse of the scorecard, or your submission of content you had no right to send.
12Using it from outside India
The scorecard is operated from India and offered to founders anywhere. We make no claim that it is appropriate or available in every country. If you use it from somewhere else, you do so on your own initiative and are responsible for complying with the law where you are.
Everything is in English, and amounts are stated in Indian rupees. Where a translation of these terms is provided, the English version governs if the two disagree.
13Governing law and disputes
These terms are governed by the laws of India. The courts of India have exclusive jurisdiction over any dispute arising from them.
If you are a consumer anywhere in the world, this clause does not deprive you of the protection of the mandatory consumer law of the country you live in, or of the right to bring proceedings there. Nothing in these terms waives a right your local law says cannot be waived.
Before starting proceedings, write to [email protected]. Most disagreements are settled faster by email than by anything that follows it.
14Changes and severability
We may update these terms. The effective date at the top changes when we do, and the version in force is the one published when you submit. If any clause is found unenforceable, the rest stands.
